RapidCull Public Beta License Agreement

1. License Grant

RapidCull Public Beta is licensed, not sold.

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the software for personal or professional evaluation and workflow use.

This Public Beta version is provided free of charge.

2. Ownership

RapidCull, including all related intellectual property rights such as source code, binaries, design, trademarks, and documentation, remains the sole property of Alex Kilian.

No ownership rights are transferred to you under this Agreement.

3. Redistribution Prohibited

You may not:

• Redistribute, share, sublicense, sell, rent, lease, or otherwise make the software available to third parties.
• Host the software for download on any website, platform, or file-sharing service.
• Repackage or modify the installer or application.

This restriction applies even though the Public Beta is free of charge.

4. Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the software, except where explicitly permitted by applicable law.
• Modify, adapt, or create derivative works.
• Remove or alter any copyright, trademark, or proprietary notices.
• Circumvent any technical limitations, expiration mechanisms, or feature restrictions built into the software.

5. Beta Status

RapidCull Public Beta is pre-release software.

It may contain bugs, incomplete features, or performance issues. Features and functionality may change significantly before a final commercial release.

We are not obligated to provide updates, continued access, or support.

This version may include an expiration mechanism.

6. Future Commercial Version

We reserve the right to release future versions of RapidCull as paid software.

Users of this Public Beta may continue to use the specific version they have obtained under the terms of this License, but this does not grant any right to future updates, upgrades, or commercial versions.

7. Feedback

If you provide feedback, suggestions, or ideas regarding RapidCull, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use, modify, and incorporate such feedback without compensation or attribution.

8. Disclaimer of Warranty

RapidCull Public Beta is provided “as is” and without warranty of any kind.

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use or inability to use the software.

Because this Public Beta is provided free of charge, total liability shall in no event exceed zero.

10. Termination

This License automatically terminates if you violate any of its terms.

Upon termination, you must immediately cease using the software and delete all copies in your possession or control.

11. Governing Law

This Agreement shall be governed by the laws of the Republic of Austria, without regard to its conflict of law principles.
